• STANDARDSWATCH TERMS AND CONDITIONS


    These terms and conditions govern your access and use of StandardsWatch (Terms and Conditions).  

    The service provider 


    SAI Global Australia Pty Limited ACN 144 974 087 of Level 37, 680 George St, Sydney, NSW 2000 (SAI Global) is the provider of the Service and provides the Service subject to these Terms and Conditions. 

    The Service 


    StandardsWatch is an on-line notification service advising users of changes to the Standards1 they have nominated on a watchlist that they have created (Service). 

    Presently, there is no charge for use of the Service but SAI Global reserves the right to levy fees in the future for the use of the Service.

    Your obligation 


    You must register and create your StandardsWatch account with SAI Global before you can access and use the Service. 

    You acknowledge that you have read a copy of SAI Global Privacy Policy, such policy as is set out on the website at https://www.saiglobal.com/en-au/privacy/, and agrees to the terms therein. 

    You agree that SAI Global may use your personal information so as to improve its services and product offering to you.  The information SAI Global plans to use includes your watchlist compilation and the change thereto over time, and this information may be used to, inter alia, analyse and monitor demand for particular Standards as well as for marketing purposes to you.  

    You are responsible for any computer equipment and software required for access to the Service. 

    Your rights of use 


    By registering your details and creating your StandardsWatch account, SAI Global grants to you a non-exclusive and non-transferable licence to use the Service for so long as you are not in breach of these Terms and Conditions or upon notification to you that SAI Global is withdrawing or shutting down the Service. 

    The granting of this licence does not transfer or assign any intellectual property rights in the Service to you.  It is expressly agreed that SAI Global retains all title and rights of ownership in the Service, including but not limited to copyright or other intellectual property rights on information provided to you as a result of you using the Service. 

    In the event you have created a StandardsWatch account and have not accessed or used it over a 2 year period, SAI Global may disable your account.  If this occurs, you will need to re-establish another account to access and use the Service. 

    Disclaimers and liability 


    Except for liability that by law (including without limitation by the Australian Competition and Consumer Act 2010) cannot be limited, SAI Global's liability to you for any reason, including breach of this Agreement, however arising (including for negligence) is limited, at the option of SAI Global, to either resupplying the Service or the payment of the cost of having the Service. 

    SAI Global does not undertake, represent or warrant that:  

    • access to the Service will be available at any or all times; 
    • the Service functionalities meet your requirements; 
    • data or information provided pursuant to the Service is accurate, timely, complete or fit for any particular purpose;  
    • the Service is error free or free of viruses; or 
    • you may obtain any benefit from the use of the Service and that you have relied wholly on your own skill and judgment in deciding to use the Service.  

    You further acknowledge and agree that the use of the Service is at your sole risk and no liability will be accepted by SAI Global or any of its related parties for any losses, costs or damages, special or consequential, arising directly or indirectly from SAI Global's provision of the Service. 

    SAI Global accepts no liability to you or any other party if you are prevented, hindered or delayed from performing any of its obligations or using the Service due to circumstances beyond SAI Global's reasonable control, including without limitation in relation to telecommunication systems. 

    You agree to indemnify and keep indemnified SAI Global against any claim by a third party (whether in negligence or otherwise) for loss or damage of any kind arising from your use or inability to use the Service. 

    SAI Global is not liable to indemnify you and must not be joined by you in relation to any claim or proceedings made or brought by you arising from the use or inability to use the Service. 

    Terms and Conditions subject to variation 


    SAI Global may vary these Terms and Conditions by notice to you of not less than 30 days before such variation takes effect.  In the event you does not agree to or accept such variation proposed by SAI Global, you agree to immediately stop using the Service and your licence to access and use the Service is forthwith revoked. 

    Term and termination or suspension of the Service 


    Without prejudice to any other remedies SAI Global may have against you for breach of these Terms and Conditions, SAI Global may terminate or suspend your access to the Service immediately if you commit any breach of these Terms and Conditions not capable of remedy or does not remedy a breach capable of remedy within 14 days of the receipt of a notice specifying the breach. 

    SAI Global may, for convenience, terminate your licence to access to the Service and/or the provision of the Service, by giving notice to you not less than 30 days. 

    Governing Law 


    These Terms and Conditions are governed by and must be construed in accordance with the laws of the state of New South Wales and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
